Acceptance of Terms

By creating an account or using the Influenger platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our service.

Service Scope

Influenger provides a SaaS platform for automating Instagram Direct Messages and managing audience engagement. The service includes:

  • Keyword-triggered automated DM automation via Instagram's Graph API.
  • Audience lead capture and management.
  • Bio link page hosting.
  • Referral program management.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

Eligibility & Account Registration

By using the platform, you represent that you are at least 13 years of age (or 18 where required by local law). You must provide accurate and complete information when creating an account. You are responsible for:

  • Maintaining the security and confidentiality of your account credentials (passwords).
  • All activities that occur under your account, regardless of whether you authorized them.
  • Ensuring your account information remains accurate, current, and complete.

We are not liable for any loss or damage arising from your failure to protect your account security.

User Content & Conduct

You retain ownership of the content and automation rules you create ("User Content"). However, you grant Influenger a non-exclusive, worldwide license to host, store, and process this content solely to provide the service. You represent and warrant that:

  • You will not use the service to send spam, unsolicited messages, or harassing content.
  • You will not violate Meta's or Instagram's Platform Policies or Terms of Service.
  • You will not engage in illegal activities, violate third-party rights, or interfere with the platform's security features.
  • You are solely responsible for the legality and consequences of the automation triggers and messages you configure.

Automation Responsibility: Influenger acts as a tool provider. We are not liable for any account restrictions, shadowbans, or permanent suspensions resulting from your use of automated messaging or triggers.

Subscriptions & Billing

Influenger offers various subscription tiers. By subscribing, you agree that:

  • Payments are processed securely by Razorpay.
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
  • No Refunds: All fees are non-refundable except as required by law or explicitly stated otherwise.
  • We reserve the right to modify fees with at least 30 days' notice.

Instagram & Meta Compliance

Influenger is a registered Meta integration. Your use of the platform is strictly subject to your continued compliance with:

You agree to indemnify and hold Influenger harmless from any claims, penalties, or damages arising from your violation of Meta's policies.

Child Safety & Protection

Influenger maintains a zero-tolerance policy regarding the exploitation of children. You agree not to use our platform to distribute, promote, or engage with:

  • Child Sexual Abuse Material (CSAM) or Child Sexual Abuse Imagery (CSAI).
  • Content that endangers the safety or well-being of minors.
  • Grooming or any form of predatory behavior.

We reserve the right to report any such activity to law enforcement and the National Center for Missing & Exploited Children (NCMEC) immediately upon discovery.

Limitation of Liability

To the maximum extent permitted by law, Influenger's liability for any claim shall not exceed the greater of ₹1,000 or the total fees paid by you in the 6 months preceding the claim. We are not liable for any indirect, punitive, or consequential damages.

Governing Law & Arbitration

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be New Delhi, India.
